United Kingdom (UK):

The CMS uses a formula to calculate the amount of child maintenance that the non-residential parent (the parent who doesn’t have the main day-to-day care of the child) should pay. The formula considers factors such as the non-residential parent’s gross income, the number of children involved, and the number of nights the children spend with the non-residential parent.

The CMS has a standard rate, and deviations may occur based on factors like shared care arrangements, additional children in the non-residential parent’s household, and special expenses.

France:

In France, child maintenance is typically determined by the judge during divorce or separation proceedings. The judge takes various factors into account, including the financial resources of each parent, the child’s needs, and the lifestyle the child would have enjoyed if the parents had stayed together. The judge may also consider the contributions of each parent to the child’s education and well-being.

French law does not have a standardised formula like the CMS in the UK, and the decisions are often made on a case-by-case basis.

Differences:

The main difference lies in the process and the entity responsible for determining child maintenance. The UK has a government agency (CMS) that uses a standardised formula, while in France, it is usually determined by a judge based on individual circumstances.
