DIVORCE & SEPARATION
Debt division in divorce who is responsible
Divorce is a challenging process that involves emotional, financial, and legal complexities. One of the key concerns for separating couples is debt division. Who is responsible for shared debts? How do laws differ between France and other countries? Understanding these aspects can help individuals navigate divorce proceedings more effectively.
International divorce
The laws governing divorce and its procedure differ from country to country.
When spouses are of different citizenships, reside in a foreign country, own property in various parts of the world or have any other international component to their relationship, divorce proceedings may be affected.
In cases of international divorce, 3 main questions arise:
– What is the competent jurisdiction for the matter?
– What law is applicable to the divorce proceedings?
– How is the divorce applicable and binding in other countries?
How to get divorced
According to article 227 of the Civil Code, marriage ends by the death of one of the spouses or by getting a divorce.
Getting a divorce is legally ending your marriage. Divorce means that you will no longer be legally joined to your partner.
A study carried out by INSEE highlights an increase in the rate of divorced couples. Indeed, the divorce rate was 10 % in 1970, reached 52 % in 2005 to drop to 44 % in 2014. The longer the marriage lasts, the lower the chances of divorce.
There are several types of divorce. Choosing the best option can be difficult, this is why it is important to know your rights and duties.
