What is the difference between a will and a trust?
When it comes to estate planning, understanding the difference between a will and a trust is crucial. A will is a legal document that outlines how your assets should be distributed after your death and can designate guardians for minor children. In contrast, a trust is a legal arrangement where a trustee holds and manages assets on behalf of beneficiaries, which can take effect during your lifetime or upon your passing. While both serve to distribute your assets, they differ in terms of when they take effect, how they are managed, and the legal processes they follow.
Uncontested divorce
In France, a mutual consent divorce is known as “divorce par consentement mutuel” or “divorce by mutual consent.” It is a specific type of divorce process that allows a married couple to end their marriage amicably without going through a lengthy and contentious legal battle.
The spouses, often with the assistance of their respective lawyers, draft a “convention de divorce” or divorce agreement. This document outlines the terms of the divorce, including how property, assets, and liabilities will be divided, child custody arrangements, and any other relevant issues.
International divorce
The laws governing divorce and its procedure differ from country to country.
When spouses are of different citizenships, reside in a foreign country, own property in various parts of the world or have any other international component to their relationship, divorce proceedings may be affected.
In cases of international divorce, 3 main questions arise:
– What is the competent jurisdiction for the matter?
– What law is applicable to the divorce proceedings?
– How is the divorce applicable and binding in other countries?
